Preamble

These General Terms and Conditions of Sale (hereinafter “GTC”) govern all contractual relationships between the manufacture Arcane Ludique, based in Geneva, and any individual or entity (hereinafter “the Customer”) placing an order via the brand’s website. By confirming an order, the Customer acknowledges having read and accepted these GTC without reservation. These conditions prevail over any other document or purchasing condition, unless expressly agreed otherwise in writing by Arcane Ludique.


1. Company identity and Customer Service

Customer Service: Our workshop is primarily a production space. For any question relating to an order or a product, please contact us exclusively in writing at contact@arcane-ludique.ch. We undertake to respond within 48 business hours.


2. Characteristics of handcrafted products

2.1. The uniqueness of wood All our items are handcrafted woodworking pieces designed and manufactured in our Geneva workshop. Wood is a natural, living material. Consequently, photographs shown on the website are not contractually binding with regard to grain and exact color. Each piece has its own “fingerprint” (knots, color variations, texture). These characteristics do not constitute defects but attest to the authenticity of the material.

2.2. Engraving and customization Any digital previews provided prior to production are indicative only. Laser engraving burns the wood; the final result (depth, contrast) depends on the density and resin content of the board used. The Customer accepts these slight artistic variations inherent to the process.


3. Availability and ordering process

3.1. Stock management Our creations range from small series to unique pieces. Availability displayed on the website is regularly updated but remains indicative. In the event that a specific wood species becomes unavailable after order confirmation, Arcane Ludique undertakes to inform the Customer within three business days and propose either a revised delivery time, an equivalent wood species, or a full refund.

3.2. Order validation An order is deemed final only after full receipt of payment. Arcane Ludique reserves the right to refuse any order from a Customer with whom a payment dispute exists or whose customization request conflicts with the brand’s ethics.


4. Production and shipping times

4.1. The time of craftsmanship Unlike industrial production, our work is made to order. Announced lead times (generally expressed in business days or weeks) include wood selection, cutting, engraving, manual sanding, application of oils/varnishes, mandatory drying time, and final quality control.

4.2. Possible delays Although every effort is made to meet deadlines, production contingencies (machine failure, supplier delays) may occur. A reasonable delay shall not justify order cancellation or claims for damages. If the delay exceeds 30 days beyond the announced date, the Customer may request cancellation and a refund.


5. Prices and taxation (VAT)

5.1. Displayed prices Prices are stated in Swiss Francs (CHF). As Arcane Ludique is subject to Swiss VAT, prices include VAT at the applicable rate (currently 8.1%) for deliveries within Switzerland.

5.2. International orders (outside Switzerland) For Customers residing outside Switzerland, invoices may be issued net of tax (depending on website configuration). However, the amount paid to Arcane Ludique covers only the product and shipping, and never includes destination-country taxes (see Article 7).


6. Payments and security

Payment is due in full at the time of order. We accept payments via [list payment methods: credit cards, Twint, PayPal]. Transactions are secured via SSL through our banking partners. Arcane Ludique does not store any banking data on its servers. In the event of payment refusal by the Customer’s bank, the order will be automatically cancelled.


7. Delivery, export and customs

7.1. Transfer of risk Products travel at Arcane Ludique’s risk until handed over to the carrier. Once the parcel is transferred to the logistics provider (Swiss Post, DHL, UPS, etc.), the Customer receives a tracking number.

7.2. Customs and import duties For any delivery outside Switzerland (European Union, USA, Canada, etc.), the Customer acts as the official importer.

  • Customer-borne charges: Customs duties, import taxes, local VAT, and carrier handling fees may be charged upon delivery.

  • Responsibility: These charges are not controlled by Arcane Ludique and cannot be anticipated or refunded.

  • Refusal of delivery: If the Customer refuses the parcel to avoid paying these charges, return costs and potential destruction fees will be deducted from the refund.


8. Receipt and transport disputes

The Customer must check the condition of the parcel and its contents upon delivery.

  • Damaged parcel: If the packaging shows signs of opening or impact, the Customer must make precise written reservations on the carrier’s delivery slip or refuse the parcel.

  • Notification: Any damage must be reported to Arcane Ludique by email, with photos, within 48 hours of receipt. After this period, the product shall be deemed accepted in perfect condition.


9. Right of withdrawal and returns

9.1. Exclusion for custom-made products In accordance with Swiss law and international practice, the right of withdrawal does not apply to products made to the Customer’s specifications or clearly personalized (engraved name, specific logo, non-standard dimensions). These sales are final.

9.2. Returns of standard products For standard (non-customized) accessories, the Customer has seven calendar days from receipt to request a return.

  • Conditions: The product must be intact, unused, and returned in its original complete packaging.

  • Costs: Return shipping costs are borne exclusively by the Customer. Refunds are issued after inspection of the goods at the workshop.


10. Warranty and wood care

10.1. Legal warranty Arcane Ludique warrants its products against manufacturing defects for two years (Swiss legal warranty).

10.2. Specific exclusions Wood is sensitive to its environment. The warranty does not cover deformation, cracking, or discoloration caused by:

  • Storage in excessively dry or humid conditions.

  • Prolonged direct exposure to sunlight or heat sources.

  • Impacts, drops, or abnormal use. Compliance with care instructions is a prerequisite for warranty coverage.


11. Intellectual property

11.1. Arcane Ludique rights All elements of the website (texts, photos, visual identity, product designs) are the exclusive property of Arcane Ludique. Any reproduction is prohibited.

11.2. Customer rights (customization) When providing an image or logo for engraving, the Customer certifies holding the necessary intellectual property rights and indemnifies Arcane Ludique against any third-party claims.


12. Personal data protection

Arcane Ludique respects Customer privacy in accordance with the revised Swiss Federal Act on Data Protection (nFADP). Collected data is strictly necessary for order processing and is never sold to third parties. Customers have the right to access and rectify their data upon request.


13. Applicable law and jurisdiction

All commercial relations between Arcane Ludique and its Customers are governed exclusively by Swiss law, excluding the Vienna Convention on the International Sale of Goods. In the event of a dispute, the parties shall seek an amicable solution. Failing that, exclusive jurisdiction is granted to the competent courts of the canton of Geneva, subject to appeal to the Swiss Federal Supreme Court.
